1. Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of the website located at maplecrestfunding.com (the "Site") and any related services offered by Maple Crest Funding Inc. ("Maple Crest Funding", "we", "us", or "our"). By accessing the Site, submitting an application, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, you must not use the Site or our services.

2. Description of services

Maple Crest Fundingoperates a referral platform that connects U.S. businesses seeking commercial financing with third-party lenders, funding sources, and capital partners ("Funding Partners"). Maple Crest Funding is not a lender. We do not make credit decisions, fund loans directly, or hold ourselves out as a financial institution. When you submit an application through the Site, we may share your information with one or more Funding Partners so that they can evaluate your business for potential financing. Any loan, advance, or other financing offer is made solely by the applicable Funding Partner and is governed by that Funding Partner's own agreements, underwriting criteria, and disclosures — not by these Terms.

3. Eligibility

You must be at least 18 years old, authorized to act on behalf of the business named in your application, and operating a business located in the United States to use our services. By submitting an application, you represent that you meet these requirements and that all information you provide is true, accurate, and complete.

4. No guarantee of funding

Submitting an application through the Site does not guarantee that you will receive a financing offer, that any offer will be on particular terms, or that funds will be disbursed within any particular timeframe. Funding amounts, rates, terms, and timelines referenced on the Site (including any maximum funding amount) are illustrative only and are not a commitment to fund. Each Funding Partner makes its own independent decision whether to extend an offer, and on what terms, based on its own underwriting criteria.

5. Accuracy of information; authorization to share

You are solely responsible for the accuracy and completeness of the information you submit. By submitting an application, you authorize Maple Crest Funding to share your application and related business and financial information with Funding Partners and service providers for the purpose of evaluating and processing your request, and you authorize those parties to contact you (including by phone, text message, and email) about your application. Providing false or misleading information may result in the rejection of your application and may have legal consequences.

6. Compensation and broker relationship disclosure

Maple Crest Funding may receive referral fees, commissions, or other compensation from Funding Partners in connection with applications we refer, whether or not those applications result in funding. This compensation does not affect the price you are quoted by a Funding Partner unless separately disclosed. We are not your agent, broker of record, financial advisor, or fiduciary, and our recommendations (if any) should not be relied upon as financial, legal, or tax advice.

7. No fee to apply

We do not charge a fee to submit an application through the Site. Any fees, interest, or costs associated with financing you ultimately accept are set by, and disclosed to you by, the applicable Funding Partner before you accept any offer.

8. Electronic communications and signatures

By using the Site, you consent to receive communications from us electronically, including by email and SMS/text message, and you agree that any disclosures, notices, or agreements we provide electronically satisfy any legal requirement that such communications be in writing, to the extent permitted by the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state law. You may withdraw this consent at any time by contacting us, though doing so may limit our ability to process your application.

9. Telephone and text message consent

By providing a telephone number, you consent to receive calls and text messages from Maple Crest Fundingand, where you have authorized us to share your information, from Funding Partners, at that number, including by automatic telephone dialing systems or prerecorded/artificial voice, for purposes related to your application. Message and data rates may apply. Consent is not a condition of obtaining financing. You may opt out of text messages at any time by replying "STOP", and you may revoke calling consent by contacting us at the details below. See the Telephone Consumer Protection Act (TCPA) for more on your rights.

10. Acceptable use

You agree not to:

  • Submit false, fraudulent, or misleading information;
  • Use the Site for any unlawful purpose or in violation of any applicable federal, state, or local law;
  • Attempt to gain unauthorized access to the Site, our systems, or other users' data;
  • Interfere with or disrupt the operation of the Site or its servers and networks; or
  • Use any automated means (bots, scrapers, etc.) to access the Site without our prior written consent.

11. Intellectual property

The Site and all content, features, and functionality on it (including text, graphics, logos, and software) are owned by Maple Crest Funding Inc. or its licensors and are protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent.

12. Third-party links and Funding Partners

The Site may contain links to, or facilitate your interaction with, third-party websites and Funding Partners that are not owned or controlled by Maple Crest Funding. We are not responsible for the content, privacy practices, or business practices of any third party. Your dealings with any Funding Partner, including the terms of any financing offer, are solely between you and that Funding Partner.

13. Disclaimer of warranties

THE SITE AND OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY APPLICATION WILL RESULT IN A FINANCING OFFER.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MAPLE CREST FUNDING INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, ANY APPLICATION YOU SUBMIT, OR ANY FINANCING OFFER OR AGREEMENT WITH A FUNDING PARTNER, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

15. Indemnification

You agree to indemnify, defend, and hold harmless Maple Crest Funding Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

16. Governing law and dispute resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, except to the extent preempted by U.S. federal law. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

17. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

18. Termination

We may suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, Funding Partners, or us.

19. Severability and entire agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Maple Crest Funding regarding the Site.
