1. Scope of this policy
This Privacy Policy describes how Maple Crest Funding Inc. ("Maple Crest Funding", "we", "us", or "our") collects, uses, shares, and protects information when you visit maplecrestfunding.com (the "Site") or submit a funding application. It applies to information we collect about you as a business owner or authorized representative applying on behalf of a business ("you"). It does not apply to the privacy practices of third-party Funding Partners, which are governed by their own privacy policies.
2. Information we collect
We collect the following categories of information:
- Identifiers: name, email address, phone number, mailing address, and business name.
- Business and financial information: industry, time in business, monthly revenue range, requested funding amount, bank account information, and other financial details you provide in connection with an application.
- Communications: the content of messages you send us through contact forms, email, or phone, and records of our communications with you.
- Device and usage information: IP address, browser type, device identifiers, pages visited, referring URLs, and similar data collected automatically through cookies and similar technologies (see Section 6).
3. Sources of information
We collect information:
- Directly from you, when you submit an application or contact form, or call or email us;
- Automatically, through your use of the Site (see Section 6); and
- From third parties, such as Funding Partners providing status updates on your application, or publicly available business information sources used to verify the information you submit.
4. How we use information
We use the information we collect to:
- Evaluate and process your funding application and match you with Funding Partners;
- Communicate with you about your application and our services;
- Verify your identity and the accuracy of submitted information, and detect and prevent fraud;
- Operate, maintain, and improve the Site;
- Comply with legal, regulatory, and contractual obligations; and
- With your consent or as otherwise permitted by law, send marketing communications, which you may opt out of at any time.
5. How we share information
We may share information with:
- Funding Partners— third-party lenders and capital providers who evaluate your application for potential financing;
- Service providers— vendors who perform functions on our behalf, such as hosting, email delivery, analytics, and identity verification, under contractual confidentiality and use restrictions;
- Legal and safety purposes— where required to comply with applicable law, regulation, legal process, or government request, or to protect the rights, property, or safety of Maple Crest Funding, our users, or others; and
- Business transfers— in connection with a merger, acquisition, financing, or sale of all or part of our business, subject to standard confidentiality protections.
We do not sell your personal information to third parties for money. To the extent any sharing described above is considered a "sale" or "share" under California law, see Section 8 for your opt-out rights.
6. Financial privacy notice (Gramm-Leach-Bliley Act)
As a business that provides financial services, we are subject to the privacy provisions of the federal Gramm-Leach-Bliley Act (GLBA) and its implementing regulations. This section serves as our GLBA-related financial privacy notice.
Categories of nonpublic personal information we collect: information from applications (name, contact details, business and financial information); information about your transactions with us or Funding Partners (such as application status and funding amounts); and information from consumer or business reporting agencies, where applicable.
Categories of nonpublic personal information we disclose, and to whom: we disclose the categories of information above to Funding Partners for the purpose of evaluating and fulfilling your funding request, and to service providers who perform functions on our behalf, as described in Section 5. We do not disclose nonpublic personal information to nonaffiliated third parties for their own independent marketing purposes, except with your consent or as permitted by law.
Your opt-out right: if our sharing practices change in a way that grants you a right under GLBA to opt out of disclosures to nonaffiliated third parties, we will provide you with notice and an opportunity to opt out before doing so. You can always contact us at the details in Section 11 with questions about how your financial information is shared.
Security of financial information: we maintain administrative, technical, and physical safeguards designed to protect nonpublic personal information, consistent with the GLBA Safeguards Rule. See Section 9.
7. Cookies and tracking technologies
We and our service providers use cookies, pixels, and similar technologies to operate the Site, remember your preferences, measure performance (for example, through analytics tools), and, where applicable, support advertising. You can control cookies through your browser settings; disabling cookies may affect the functionality of the Site.
8. California privacy rights (CCPA/CPRA)
If you are a California resident (including a sole proprietor or individual acting in a business capacity, where applicable under California law), the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, "CCPA"), provides you with the following rights with respect to your personal information:
- Right to know the categories and specific pieces of personal information we have collected, used, disclosed, and (if applicable) sold or shared about you, and the purposes and categories of third parties involved;
- Right to delete personal information we have collected from you, subject to certain exceptions;
- Right to correct inaccurate personal information;
- Right to opt out of the sale or sharing of personal information, and of certain uses of sensitive personal information; and
- Right to non-discrimination for exercising any of these rights.
As described in Section 5, we do not sell personal information for money. To the extent any disclosure to a Funding Partner or advertising/analytics vendor is considered a "sale" or "share" under the CCPA, you may submit an opt-out request using the contact details in Section 11 or by emailing hello@maplecrestfunding.com with the subject line "Do Not Sell or Share My Personal Information". You may also designate an authorized agent to submit a request on your behalf, subject to verification.
We will verify your identity before fulfilling a request to know, delete, or correct, using information you have already provided to us. We will not discriminate against you for exercising your CCPA rights.
9. Other state privacy laws
Residents of certain other states (for example, Virginia, Colorado, Connecticut, Utah, and others that have enacted comprehensive privacy laws) may have similar rights to access, correct, delete, and obtain a copy of their personal information, and to opt out of certain processing. Many of these state laws include exemptions for information already regulated under GLBA. You may exercise applicable rights using the contact details in Section 11.
10. Data retention
We retain information for as long as necessary to fulfill the purposes described in this policy, including evaluating your application, complying with legal and regulatory record-keeping obligations, resolving disputes, and enforcing our agreements. Retention periods vary depending on the type of information and applicable legal requirements.
11. Data security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal and financial information from unauthorized access, use, or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
12. Children's privacy
The Site is intended for business owners and authorized representatives 18 years of age or older. We do not knowingly collect personal information from individuals under 18.
13. Third-party websites
The Site may link to or facilitate interactions with third-party websites, including those of Funding Partners. This policy does not apply to those third-party sites, and we encourage you to review their privacy policies before providing personal information to them.
14. Changes to this policy
We may update this Privacy Policy from time to time. The "Last updated" date above reflects the most recent revision. Material changes will be reflected on this page, and, where required by law, we will provide additional notice.
